  8. Product availability

    Lead time is dependent on stock availability. Should we have stock available, orders will be packed within one business day of payment being validated/received. You can choose to collect your order from our premises once packed during our normal business hours or you can ask for delivery and the order will be dispatched for delivery within two business days thereafter at the cost communicated to you.

    Every effort is made to effect delivery of your order timeously however unforeseen circumstances may cause delays. Should we be faced with such an occurrence we will contact you via email and provide a revised delivery schedule.

    Foodieness Pty Ltd. only delivers within the built-up urban areas that form part of Pretoria. If you are uncertain whether you fall within the region to which we deliver, kindly confirm with us prior to placing an order. We take no responsibility for delivering orders to areas outside of our delivery zone and the onus will be on the customer to collect the order from our premises.

    When you click to make a purchase with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms & conditions. You must not make any purchase through this site unless you understand and agree to all our terms and conditions. Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase.   9. Delivery

    Foodieness Pty Ltd. does not make use of a third-party delivery provider. Due to the perishable nature of many of our products deliveries are made by our own staff. Please ensure the correct delivery address is provided from the outset as title and risk will pass to you once the order has reached the provided address. Please ensure that there is someone available at the specified address to receive the delivery.

    In the event that no one is found present at the specified address when delivery is attempted, the provided telephone numbers will be contacted. Should we still not be able to reach anyone at the specified address we will return the goods to our premises where they can be collected by the customer. Should you wish us to deliver them again, we reserve the right to charge additional delivery fees and to only deliver once the payment of such fees has been received.

    In the case where delivery to the specified address was unsuccessful, and hence there is a delay in goods reaching you Foodieness Pty Ltd. takes no responsibility for the deterioration of perishable goods that may occur before you receive the goods.

    We require a person to receive and sign for the goods on delivery. Should you require us to leave goods at an unoccupied premises, we require notice of this in writing and we cannot be held responsible in any way for the completeness or condition of the goods by the time you reach the specified premises. In such cases it is automatically assumed that we delivered all the goods in good condition to the specified address and the customer has no claim whatsoever against us should goods be missing or damaged.

    Should you wish to change the delivery address after your order is placed, kindly notify us in writing at support@foodieness.co.za as timeously as possible. We always try to accommodate our customers as far as possible. We reserve the right to refuse, at our sole discretion, delivery to the new address in which case the onus will fall on you to collect the goods from us. Should we agree to deliver to the new address and this results in a delay in delivery, we take no responsibility for the deterioration in perishable products that may occur due to this delay.

  10. Order processing

    Order processing will not begin until we receive a confirmed order and full payment.

  11. Refunds/returns Policy

    Due to the perishable nature of many of our products we do not accept returns or order cancellations and do not give refunds. Should you be dissatisfied with the quality of a product we supply, you are welcome to return it to us in the original packaging for our assessment. In cases where we deem it reasonable, in our sole judgement, we will provide a replacement product or a credit for the applicable amount, at our sole discretion.

  12. Payment Options and Pricing

    All transactions will be processed in South African Rands (ZAR). Foodieness Pty Ltd accepts payment through South African-based MasterCard and Visa cards as well as direct bank transfer (EFT) and Master Pass.

    Foodieness Pty Ltd. endeavours to offer you competitive prices on current products; you’re total order price will include the price of the purchase plus any applicable sales tax and shipping charges (on the day of shipping).
    Foodieness Pty Ltd. reserves the right to change pricing at any time without prior notice at their sole discretion.

  13. Security Policy

    1. Virtual Card Services process all credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. The company registration documents and the site’s registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.
    2. Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet servers are protected by firewalls and intrusion detection systems.
    3. Foodieness Pty Ltd. does not have access to card details.

    The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

    I understand that all the designs and trademarks are registered to Foodieness Pty Ltd. and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Foodieness Pty Ltd. for any civil action or any legal action deemed necessary against me.
